Tax Law and defense in tax enforcement proceedings
Tax collection often arrives late: first comes service of process in tax enforcement proceedings, sometimes already a freeze on bank accounts. Before paying or entering an installment plan, it is necessary to know where the tax claim comes from and whether it is still enforceable.
Tax collection must be examined from the origin of the tax claim.
By the time the debt reaches the taxpayer, the process has usually already moved forward. Entry in the registered tax debt roll (dívida ativa) turns the claim into an enforceable instrument and opens the way to tax enforcement proceedings, which may reach bank accounts, vehicles, and real estate. Not every claim withstands scrutiny, however: some claims are time-barred, some amounts were calculated in error, some assessments are duplicated, and some enforcement actions are directed at parties who are not legally liable for them.
The certificate of registered tax debt and the case documents are the starting point, compared with the payment slips, notices, tax returns, and accounting records gathered by the taxpayer. This review shows what can be done in each situation: a pre-enforcement objection (exceção de pré-executividade), a motion to oppose enforcement (embargos à execução), an administrative request for review, or enrollment in an installment plan. Defense in tax enforcement proceedings
The review focuses on the certificate of registered tax debt, whether service of process was valid, and any seizure measures already taken, to determine whether the claim and the amount demanded hold up.
Pre-enforcement objection and motions to oppose enforcement
Time-barring of collection (prescrição), expiry of the right to assess (decadência), payment already proven, or an assessment error may be raised through a pre-enforcement objection (exceção de pré-executividade). Issues that require evidence to be produced usually call for a motion to oppose enforcement (embargos à execução).
Account freezes and attachment of assets
Once an amount is frozen or an asset attached, the legal limits on the seizure, the grounds for exemption from attachment, and the possibility of substituting the security provided come into question.
Entry in the registered tax debt roll
Before and after entry in the roll, the assessment may still be reviewed at the administrative level, by pointing out inconsistencies in the calculation and disputing the inclusion of partners or managers as defendants in the collection.
IPTU and municipal taxes
Municipal tax charges, such as the IPTU (urban property tax), may involve discrepancies in built area, property use, the tax base, or who the assessment is addressed to. The review starts from the floor plan and the municipal property register.

The first step is to identify the proceeding in which the freeze was ordered and the debt that gave rise to it. From there, the validity of service of process, the nature of the funds affected, and any grounds for exemption from attachment — such as wages and amounts intended for subsistence — are checked. That review determines the appropriate request: release of the funds, substitution of the security, or a defense against the debt itself.
Entry in the roll does not end the discussion. What is examined is whether the claim remains enforceable: limitation and expiry periods, the accuracy of the calculation, and whether there was a prior payment or installment plan. Depending on the outcome of that review, the dispute may proceed at the administrative level or in court.
Enrollment usually involves an acknowledgment of the debt and may narrow the scope of future disputes over that claim. That is why the order matters: first, the review considers whether there are grounds to contest the assessment; then that scenario is compared with the program’s terms and with the effects of enrollment on tax clearance certificates and security.
